Voluntary Action Program

With the advent of Ohio's Voluntary Action Program, HzW has been able to incorporate its regulatory knowledge and practicable experience to convert brownfield sites into viable property for redevelopment. Under the supervision of HzW's Certified Professionals, we are able to provide complete guidance through each aspect of Ohio's Voluntary Action Program.

Human Health Risk Assessments

HzW has extensive experience in completing human health-based risk assessments in accordance with the VAP, as well as under Ohio and federal RCRA requirements, BUSTR requirements and CERCLA. HzW's risk assessors are diligent in "crunching the data" for completing the site evaluation, documenting complete exposure pathways in the exposure assessment, researching the toxicity of each compound of concern during the toxicity assessment phase, and completing the risk characterization. Many of the RCRA Closure and VAP projects completed by HzW include a health-based risk assessment to demonstrate that the presence of the chemicals of concern do not present a risk to human health, or to aid in establishing site-specific clean-up goals to meet risk-based criteria.

Experience with Ohio's Brownfields Program, Voluntary Action Program (VAP)

Since its inception in 1994, HzW has been recognized as a leader in Ohio's VAP, which constitutes Ohio's Brownfields Redevelopment Program. HzW's Certified Professionals under the VAP are Matthew D. Knecht (Ohio EPA Certified Professional No. 0105) and John A. Zampino (Ohio EPA Certified Professional No. 280). Mr. Knecht is President of HzW and Mr. Zampino is a Senior Geologist, and either Mr. Knecht or Mr. Zampino would serve as Project Manager for any VAP project.

Under Mr. Knecht's direction in 1994 and 1995, HzW prepared and signed the "No Further Action" letters which resulted in issuance of the first two "Covenants Not to Sue" issued by the Ohio EPA (the Kessler Products and former Strongsville Airpark sites) under the VAP. Since that time, HzW has prepared a total of 20 No Further Action (NFA) letters and received a total of 15 Covenants Not to Sue. While others may assert a claim of experience with Ohio's VAP, HzW can demonstrate and document success with the program.

    In addition, HzW has several projects in process which are in various stages of pursuing a Covenant Not to Sue under the VAP. Some of these projects are in the early stages (Phase I assessments, eligibility determinations, etc.) while others are nearing completion (risk assessment or NFA letter preparation).

    Our goal in emphasizing our VAP experience is to highlight HzW's ability to provide thorough, complete environmental site assessment services. However, our capabilities are not limited to the VAP. HzW has a proven record of providing conventional "pre-purchase" environmental site assessments, as well as more complex "due diligence" investigations associated with corporate mergers and acquisitions.
